Two young men now face capital murder charges. That is the top murder charge in Texas. The charge comes from a deadly shooting at a San Juan H-E-B on July 16.

Juan Samuel Olguin of Alamo and Michael Anthony Lopez of Pharr were indicted on Oct. 8. Both are 19. They are accused of killing Hervey Marin De Leon, 40.

Olguin also faces three possession charges. Lopez faces one more charge. It is aggravated assault with a deadly weapon.

San Juan police got reports of gunshots at about 11 a.m. on July 16. They also got reports of two cars speeding away. Police say one was a white Chevrolet Malibu. The other was a black Dodge Charger.

The police news release says the victim's brother told them he drove him to the H-E-B. He said they went to buy drugs from Lopez. Police say the brother stayed in the driver's seat. He told police that Lopez got in the back seat and shot the victim. Then Lopez went back to the Charger. The brother drove the victim to a McAllen hospital.

Police say they picked up Lopez and questioned him. They say Lopez told them Olguin drove him to the H-E-B for a drug deal. Police say Lopez said the victim pulled out a handgun. They say Lopez then pulled his own gun. He shot several times at close range, police say. Police say Lopez hid the gun in a shed at his home. They say they found it there.

Police say they found the Charger in an open garage at Olguin's home. Officers had search warrants. Police say they found Olguin at his girlfriend's apartment in San Juan.

Police say Olguin told them he drove Lopez to the H-E-B to pick up $10,000. They say he heard gunshots. They say he drove off when Lopez got back in the car. Police say Olguin said Lopez told him he had shot the man.

The police news release says it is still unclear why the shooting happened.

Both men are still in jail. Olguin is held on a $1,202,500 bond. Lopez is held on a $735,000 bond. A judge set bond at $1 million for each man in July.

Next come the arraignments. The men hear the charges in court. Then they enter a plea. Lopez is set for Oct. 28. Olguin was set for Oct. 21. Court clerk information now shows Oct. 26.

In July, El Tejano also reported a third arrest in the case. Police arrested Ivory Ruiz on July 23. The charges were hindering apprehension, assault on a peace officer and resisting arrest.
