Austin police have arrested a 21 year old man in a deadly shooting. It happened on the city's northeast side.

Joitorian Bouye is charged with first degree murder. In Texas that charge can mean 5 to 99 years or life in prison.

The shooting happened on Saturday, August 29. Police got the call at 5:34 p.m. The address was the 11700 block of Timber Heights Drive.

People who called 911 said a man had a gun. They said someone had been shot. The first call went out as a shooting or a stabbing. It turned out to be a shooting.

Officers found Tyrell Pordia, 35, when they got there. He had been shot. Medics could not save him. He died at the scene at 5:53 p.m., police said.

Pordia was the 38th person killed in Austin this year.

Witnesses told police the shooter ran off. Officers spread out and looked for him. Police said they found him about an hour after they got there.

Bouye was about half a mile away. He gave up without a fight, police said. Officers said he had a handgun on him. They said he also had two kinds of bullets in his pockets.

Detectives took him in and asked him what happened. Police say he admitted that he shot Pordia.

Court papers say the two men were not strangers. Pordia was dating Bouye's aunt.

Neighbors told police they heard the two men arguing before the shots. Court papers say one word kept coming up in that fight. The word was "trafficking." Then the neighbors heard gunfire.

Bouye's aunt told police she saw him with a gun in his hand. She said he was yelling about trafficking. Then he jumped a fence and ran, court papers say.

Officers picked up spent rifle shells at the scene. Court papers say the shells matched an AR-15. That is a rifle, not a handgun.

Court papers also say Bouye told a detective why he did it. He said Pordia gave him "bad vibes." He said he thought Pordia wanted him dead. He told the detective he has schizophrenia.

Police put the case number at 26-2411173. Bouye is due back in court on September 11.

Officers told the public there was never a threat to the block. They said the two men knew each other, so this was not a random attack.

That answer matters to the people who live there. Neighbors heard a fight and then a rifle going off on a Saturday evening.

The killing was the first of two in Austin that weekend. The next day, on August 30, police found a man dead inside a car in southeast Austin. That car had hit a fence near Briar Hill Drive and Woodland Avenue. The man inside was already dead.

Nobody has been arrested in that one. Police are still looking for a suspect. El Tejano wrote about that case here: https://www.eltejanorgv.com/a-car-hit-a-fence-in-austin-the-man-inside-was-already-dead/

The two cases are not connected. They are two different streets, two different days and two different sets of facts. But together they made 38 and 39 on Austin's homicide list for the year, and both landed inside 24 hours.

Austin police are still asking for help on both. Anyone who knows something about the Timber Heights shooting can call 512-974-TIPS. Tips can also go to Capital Area Crime Stoppers at 512-472-8477. There is a web form at austincrimestoppers.org. Callers can leave their names out of it.

Bouye's next court date is September 11, court papers say.

A charge is not proof. Everyone is innocent until a court says otherwise.
