A trooper says a driver was going 78 mph on US 83 in Starr County. The limit there is 65. By the end of the stop, he was in handcuffs over a vape pen.

That is what a trooper wrote in a sworn probable cause affidavit. The driver is Abdiel Gonzalez. He is charged with having a small amount of an illegal drug. Under Texas law, it is a felony.

The affidavit was signed by Trooper Arnaldo Gonzalez Jr. These are claims by the trooper. They have not been proved in court.

It happened on Thursday, Aug. 27, 2026, at about 6:18 p.m. The trooper was on patrol, going west on US 83 near mile marker 834.

He saw a white Infiniti Q40 going east. The affidavit says it was going 78 mph in a 65 mph zone. The trooper pulled the car over.

The trooper asked the driver to step out. Then he asked if he had anything illegal on him.

The affidavit gives the driver's answer this way: "He said I have a vape pen."

The trooper asked to see it. The driver handed it over. The trooper called it a "THC Vape pen" in the affidavit.

The trooper wrote that he looked inside the pen. He saw a "honey like substance." He wrote that it was "not consistent to nicotine." In plain words, the trooper did not think it was nicotine.

He then put Abdiel Gonzalez in handcuffs. The trooper let another person take the car.

Abdiel Gonzalez was taken to the Starr County Sheriff's Office. The trooper wrote that he was handed over to jail staff "without incident." That means there was no trouble.

The charge is possession of a controlled substance in Penalty Group 2, less than 1 gram. That is a state jail felony. It can mean 180 days to 2 years in a state jail.

The affidavit does not say the liquid was tested. It does not say how much was in the pen. It only says the trooper saw a honey like liquid that did not look like nicotine.

The affidavit also does not say if the driver got a speeding ticket.

The affidavit form does not show a date it was sworn. The part where a judge signs to find probable cause is blank on this copy. It does not list a bond or a court date.

Everyone is presumed innocent until proved otherwise.
