A pregnant woman lost her unborn baby after a crash caused by a Border Patrol agent in Starr County. That is according to a news release from the family's attorney.
The crash happened Monday near La Grulla. Texas state troopers say a Border Patrol truck was driving through a crossover on US 83. A crossover is the gap in the highway median that lets drivers turn around. The agent wanted to cross over and head west. Troopers say the agent did not stop at the stop sign there.
The Border Patrol truck pulled into the road and hit a Chevrolet Traverse. The crash happened around 2:46 p.m., west of FM 2360, near Border Patrol Lane. A woman and her four young children were riding in the Traverse. All four kids and their mom got hurt. The Border Patrol agent driving the truck got hurt too.
Now the family's attorney, J. Michael Moore, says the woman was pregnant when the crash happened. He says the unborn child died because of the crash.
Moore sent a letter to the U.S. Attorney's Office in McAllen on Thursday. The letter asks the federal government to save all evidence from the crash. That includes the Border Patrol truck and the data stored in its "black box," a small device that records how a vehicle was moving right before a crash. The letter also asks the government not to pull data off the truck unless the family's own experts can be there to watch.
Moore is also asking the Starr County District Attorney's Office to look into whether criminal charges should be filed over the injury and death of the unborn child. No charges have been filed. The Border Patrol agent has not been named.
"This is a country of law and order, and the law applies to the government the same as it applies to everyone else," Moore said.
Moore said he will go before a federal judge in McAllen to ask for emergency help protecting the family's rights if the government will not agree in writing to save the evidence.
The Texas Department of Public Safety is still investigating the crash. DPS has not released the names of anyone involved, including the agent.
Everyone is presumed innocent until proved otherwise.
