A Roma man is charged with a felony. A Starr County deputy says he took off the ankle monitor he had to wear.

Osiris Ediel Tamez faces a charge of tampering with an electronic monitoring device. In Texas, that is a state jail felony. It can mean 180 days to 2 years in a state jail.

Deputy Jesus Carmona of the Starr County Sheriff's Office filed the complaint under oath on August 19. A justice of the peace in Precinct 4 signed a warrant for Tamez the same day. The story below comes from that sworn complaint. These are claims. They have not been proved in court.

The call came on Wednesday, August 12. At about 7:52 p.m., dispatch sent Carmona to a home in Roma. The call was for an information report.

At the home, Carmona spoke with Tamez's mother. She told him what she found that evening, according to the probable cause affidavit.

She said her son had been quiet for some time. Around 6 p.m., she walked into his bedroom. He was not there. She told the deputy he had cut off his ankle monitor.

The monitor was left on the nightstand next to the bed. A pair of toenail nippers sat near it, the deputy wrote. The affidavit does not say what was used to take the monitor off.

She had last seen her son around 3 p.m. inside the house. She said she did not hear him leave.

She also saw a black trash bag full of clothes. It was on the floor next to the bed.

The last time they talked, she said, he was upset. He told her he could not find a good paying job. He was also frustrated with being home all the time, she said.

The documents give two reasons he had to wear the monitor. His mother told the deputy he was on state probation. She said the monitor was a rule he had to follow.

The formal charge says something a bit different. It says he had to wear the monitor as a condition of mandatory supervision. In Texas, that is a kind of release under watch, a lot like parole. The documents do not say what earlier case put Tamez under watch.

Texas made this its own crime in 2023. The law covers people who must wear a tracking device for probation, parole, mandatory supervision or bail. It is a crime to knowingly take off or turn off that device.

Carmona served the warrant on August 27 at about 2:30 a.m. The officer's return lists the place as the Starr County Jail. It does not say where Tamez was between August 12 and August 27. It also does not say how he ended up at the jail.

The court documents do not list a bond amount. They do not list a court date. They do not name a lawyer for Tamez. The sheriff's office case number is 2026-01788.

El Tejano will follow the case as it moves through the Starr County courts.

Everyone is presumed innocent until proved otherwise.
