Police in Rio Grande City arrested a 29 year old man. He broke an apartment window during a fight with his common law wife. He also ripped an air conditioner out of the wall.

Officers say Xavier Hernandez did the damage while drunk. He was mad at his common law wife when it happened.

The fight took place about 4:10 p.m. on July 31, 2026. It happened at an apartment in Rio Grande City. The Starr County Housing Authority owns the apartment. Police got a call about a fight at the home. A man and a woman were arguing inside. Officers went to check it out.

Hernandez is not accused of hitting anyone. He is charged for the damage he caused.

When the officer got to the apartment, Hernandez's common law wife was there. She is also 29 years old. She told the officer that Hernandez was very drunk. She said he was being verbally aggressive toward her. But she said he was never physical with her.

She told police what happened next. She said Hernandez broke the apartment's south window. She said he also pulled the air conditioning unit out of the wall. The officer then talked to Hernandez. Police say he seemed drunk. He talked a lot and would not stop. He had small cuts on his right arm. The blood on his arm had already dried up. That was by the time the officer got there.

Hernandez told the officer why he did it. He said he broke the window because he got upset. He found out his common law wife knew about his girlfriend. Paramedics came to the scene and treated the cuts on his arm. After that, Hernandez got loud with them. He would not cooperate. He told the paramedics he did not want to go to the hospital. He refused to go. He never went.

The officer arrested Hernandez for the broken window. He now faces a charge called criminal mischief. That means he is accused of damaging someone else's property on purpose.

His charge is a Class B misdemeanor. That is a lower level charge in Texas law. Police say the damage is worth between $100 and $750.

A Class B misdemeanor in Texas can bring real punishment. It can mean up to 180 days in the county jail. It can also mean a fine up to $2,000.
